Turkey puts pressure on foreign museums involved in artefact disputes

Turkey is applying more pressure to the foreign museums that it claims contain looted Turkish artefacts. Various exhibition loans to these museums are now being cancelled, in an attempt to convince the institutions involved to take the issue more seriously & attempt to resolve it.

Turkey is set on a collision course with many of the world’s leading museums, by refusing exhibition loans because of antiquities claims. European museums that are being targeted include the Louvre, Berlin’s Pergamonmuseum, the British Museum, and the Victoria and Albert Museum. In America, claims are being lodged against New York’s Metropolitan Museum of Art, the J. Paul Getty Museum, Los Angeles, Cleveland Museum of Art and Dumbarton Oaks, Washington, DC. Turkey’s tough new approach was first reported by The Art Newspaper (March 2012, p1, p10; April, p6).

Among the exhibitions that have been hit is a British Museum project on the Uluburun ship, the world’s oldest recovered wreck. Dating from the 14th century BC, it was discovered (with its cosmopolitan cargo) in 1982, six miles off the south-west Turkish coast. It was put on display 12 years ago at the Bodrum Museum of Underwater Archaeology. The British Museum was discussing an exhibition, along with reciprocal loans to Turkey, but this has had to be dropped because of Turkey’s claim for the Samsat stele.

Asia Society discusses benefits of a “Wikiloot” database

The Asia Society in New York held a panel on collecting ancient art in the 21st century on 18 March along with the American Committee for Cultural Policy.

The first half of the panel primarily covered legal aspects concerning collecting art from China and India. The international art dealer James Lally went into depth about some of the misconceptions that the collecting community has about the memorandum of understanding between China and the US, and Naman Ahuja, a professor of Indian art and architecture from Delhi, spoke adamantly about how he believed that western collectors should help museums from source countries by lending their expertise.

Hillary Clinton travels to Athens to sign cultural heritage protection memorandum

US Secretary of State, Hilary Clinton, has signed an agreement with Greece, to restrict importation of antiquities, in an aim to help prevent looting of archaeological sites.

ATHENS. While in the Greece on a diplomatic visit this weekend, US Secretary of State Hillary Clinton signed a Memorandum of Understanding with Greek Minister of Foreign Affairs, Stavros Lambrinidis, concerning the imposition of import restrictions on archaeological and Byzantine objects. The new memorandum, which still has to be ratified by the Greek Parliament, would make it illegal for protected works of art to enter the US without the approval of Greek authorities.

The signing of the memorandum was yet another demonstration of the US government’s vocal support of Greece’s austerity measures to help the debt-ridden country get back on its feet. “America is just as committed to Greece’s future as we are to preserving your past,” Clinton said at the signing. “During these difficult economic times, we will stand with you. We are confident that the nation that built the Parthenon, invented democracy, and inspired the world can rise to the current challenge.”

Cyrus Cylinder to remain in Iran until spring following loan extension

Cyrus Cylinder to remain in Iran until Spring

The British Museum (BM) has agreed to extend the loan of the Cyrus Cylinder to Iran’s National Museum. Although it was due to be returned on 16 January, BM trustees took the unusual decision to offer a last-minute extension. As we predicted, it has now been accepted that the antiquity, an inscribed royal decree of 539 BC, can continue on loan to Tehran until 15 April, after the Iranian new year holidays.

A BM spokeswoman explained: “This decision has been taken in recognition of the fact that the exhibition has proved to be very popular. The extension will give an opportunity for people from the provinces, including school groups, to visit the exhibition during the No-Ruz (new year) holidays around 20 March.” So far the Cyrus Cylinder has been seen by over 200,000 visitors, who are allowed in to the gallery on a timed entry system to view the antiquity for a few minutes each.

What was achieved by the trial of former Getty curator Marion True in Italy?

Following on from the end of Marion True’s trial, it seems as though this is a case where the approach of direct legal action by Italy may have caused as many problems as it solved. Huge amounts were spent on a trial involving an institution that had been largely cooperative regarding the return of disputed artefacts in the past (bear in mind that this article is from the perspective of the Getty however – I think that this cooperation might not have seemed to apparent to the other parties that wanted artefacts returned that they knew were looted, yet didn’t have conclusive proof of this.

The trial of Marion True, the former antiquities curator of the Getty Museum (which for many years has been one of the leading collectors of world-class antiquities), for conspiring to receive antiquities that had been illegally excavated and exported from Italy, began on 16 November 2005. The Art Newspaper has been covering the trial since its outset. Until March 2009, the prosecution worked through its case, and then the defence began cross-examining witnesses, but True has had no opportunity to present her case directly. Here, she tells The Art Newspaper about the trial and its outcome.

A headline in The Art Newspaper in June 2010 announced that the trial in Rome against me had “collapsed” after five years, the statutes of limitations for all crimes of which I was accused by the Italian state having expired. The court officially recognised this fact on 13 October in a hearing of 12 minutes. Thus, my five-year long trial ended without judgment—neither condemnation nor vindication, a reality hard to accept, given the distorted and slanderous allegations against me. Throughout, my lawyers advised me not to speak out, not to undermine my defence.

“In the sense of trying to comprehend all that’s happened I am in shock. That it has been five years, with never the possibility of airing the defence—it was a very long time,” Marion True, former antiquities curator of the Getty Museum in Los Angeles, told the New Yorker. Last month in Rome, she saw charges against her of conspiring to receive antiquities that had been illegally excavated and exported from Italy, dismissed. The case was closed after a marathon five-year trial because the statute of limitations had expired.

The trial began on 16 November 2005, following a ten-year investigation into her associations with co-defendants Swiss dealer Robert Hecht and art expert Giacomo Medici. The case was triggered in 1995 when Swiss and Italian authorities raided Medici’s Geneva store and found thousands of photographs and records which they claimed showed illegally excavated antiquities.

Are some more of the artefacts looted by Giacomo Medici up for sale?

At first I thought I was reading an older story – but it appears that there is another auction of artefacts that are now suspected to have been through the warehouses of Giacomo Medici.

Bonhams London is to auction two antiquities that may have passed through the hands of the dealer Giacomo Medici, who has twice been found guilty of trafficking in antiquities in Italy, but is free as he mounts his third and final appeal. As we went to press, the auction house had not withdrawn the lots because the necessary information on the items had not been released, despite Bonhams’ repeated requests to the Italian authorities, they say.

Pictures in the Bonhams catalogue of the two works coming to auction on 6 October appear similar to Polaroids found in Medici’s Geneva store, which were seized in 1995 and presented as evidence during his trials, although these particular objects were never examined in court. This means that the objects have not been studied to establish their origins and whether or not they were illegally excavated or exported and may be legitimate.

The British Museum’s (BM) loan of the Cyrus Cylinder to Iran has been delayed, because of a major discovery in London. Part of Cyrus the Great’s text has been found on two fragments of inscribed clay tablets.

The first fragment was identified on 31 December by Wilfred Lambert, a retired professor from Birmingham University, who was going through some of the 130,000 tablets at the museum. Although it had been seen by earlier scholars, no one had linked the text to the Cyrus Cylinder.

Parliamentary bill on Nazi-looted art

The signs are promising that Andrew Dismore’s bill to allow the restitution of art looted during the holocaust may become law. This is a step that must be welcomed, yet such measures as this & the Human Tissue Act highlight the need for coherent legislation that tackles all restitution issues, rather than piecemeal laws that only manage to be passed by skirting around the big restitution cases.

LONDON. A Private Members’ Bill is to be presented for its second reading in parliament on 15 May, to allow UK national museums to deaccession art works spoliated during the Nazi period.

The Department for Culture, Media and Sport (DCMS) is expected to support the bill, subject to drafting changes, which will greatly increase its chances of eventually becoming law. The DCMS originally hoped to incorporate a clause allowing deaccessioning of Nazi-era spoliation into the Heritage Protection Bill, but last December the bill was dropped, because of pressure of government business in Parliament.

Bronze drum stand in the British Museum may be looted

Evidence suggests that an artefact currently on loan to the British Museum for a temporary exhibition may have been illegally excavated. It could be argued that although the museum does not own the artefact, it is going against its own loan guidelines in accepting it for the exhibition.

LONDON. The centrepiece of the Chinese bronzes exhibition, “Treasures from Shanghai”, at London’s British Museum appears to have been illegally excavated within the past few years. However, it is now legitimately the property of the Shanghai Museum. The British Museum show is the first time the bronze has been exhibited.

Dating from 770-476 BC, the drum stand is decorated with three intertwined dragons. It probably comes from the tomb of a ruler, from a site that is unknown to archaeologists, possibly in Shanxi Province. Other important finds, such as musical instruments, may well have been looted from the tomb.

Freer circulation of cultural artefacts

Depending on who you speak to, freer circulation of cultural property is either a great idea, or a terrible thing. It all hangs on whether they think they will benefit or not from such a move. Those who argue against help to prop up the anti-deaccessioning clauses in the charters of many of the UK’s leading museums. Maybe people need to accept that there is no right or wrong answer – what is good in some situations may be bad in others – so it should not be the role of the law to put blanket regulations in place that stifle any efforts at interpretation based on the case in hand.

A few years ago, I received a grant from the Getty Foundation for a project on museums in South Asia. I was just about to send 12 researchers to around 100 museums all over India, to get a sense of what place museums occupy in the social landscape of the country today. I asked the Secretary of the Department of Culture for a letter of support, but when I met her, I got an earful. She said, you are going to send people to museums in remote places that have valuable artefacts and very poor security. You will submit your reports to the Getty, and then all our things will begin to disappear.

I dismissed this bureaucrat’s remarks as an aberration, but in 2007 the same sorts of anxieties surfaced next door to India, as the Bangladesh National Museum made preparations for a loan exhibition to the Musée Guimet in Paris.

Do global museums really serve everyone?

The so called “Universal Museums” claim to represent the whole world, but it must be borne in mind, that this is an entirely self-appointed role, which comes at the expense of many specialist local museums. Proclaiming that they are in a different category of institution, to which the rules don;t apply in the same way as they do to others, raises far more problems than it solves.

LONDON. The world’s leading museums have for the first time united to issue a declaration. Their statement on “the importance and value of universal museums” follows increasing concern about the politicisation of Greek claims against the British Museum (BM) over the Parthenon Marbles.

Although the declaration released in December does not specifically mention the marbles, it points out that the acquisition of classical antiquities from Greece by European and North American museums “marked the significance of Greek sculpture for mankind as a whole and its enduring value for the contemporary world.”
